Can a sitting president be prosecuted? Might Donald Trump, or any president, face the prospect of jail?

A memorandum of law, written in 1998 but released last week, concludes that the answer is a qualified "yes." The memorandum was written by Chapman University law professor Ronald Rotunda, who was then at the University of Illinois, for Kenneth Starr, the independent counsel appointed to investigate President Bill Clinton.

Rotunda's memorandum is learned, illuminating and impressively detailed. The issue is both tough and unsettled. But there's a better answer: an unqualified "no."

The drafters of the Constitution spent a lot of time on the question of how to respond to presidential wrongdoing. Their remedy was impeachment (by the House of Representatives) and then conviction (by the Senate), which could occur for "Treason, Bribery, or other high Crimes and Misdemeanors."

But what happens if the president is convicted by the Senate? Here's the constitutional answer:

"Judgment in Cases of Impeachment shall not extend further than to removal from office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law."

A reasonable interpretation of this provision is that it sets out a temporal sequence: Impeachment, then conviction and removal from office — and only after that, indictment, trial, judgment and punishment.

Alexander Hamilton seemed to read the provision exactly that way: "The President of the United States would be liable to be impeached, tried, and, upon conviction of treason, bribery, or other high crimes or misdemeanors, removed from office; and would afterwards be liable to prosecution and punishment in the ordinary course of law."

That means you can't indict and try a sitting president. He has to be removed first.

True, this interpretation isn't inevitable. You could read the text to mean only that the consequence of conviction is removal from office, and that a convicted president can be prosecuted — but to be silent on, and so not to resolve, the question whether a president can be prosecuted for crimes while in office. On that interpretation, nothing in the Constitution rules out a prosecution of the president for (say) obstruction of justice or for perjury.

Rotunda also emphasizes that a president might commit crimes, such as battery, shoplifting and document destruction, that may not be "high" in the constitutional sense, and so not a legitimate basis for impeachment. If he's immune from prosecution, does the president get a free ride? Since the founders believed no one should be above the law, Rotunda doesn't think that makes a lot of sense.

Importantly, though, he does not contend that the president can be prosecuted for actions he undertakes in his official capacity. His conclusion that a sitting president can be prosecuted is strictly limited to actions committed before becoming president, and actions that a president does not undertake in his role as president, such as Clinton's alleged perjury. (True, the line between the official and unofficial acts can be thin.)

The problem with Rotunda's argument is that presidential immunity from criminal prosecution — while in office — is a pretty reasonable inference from the constitutional design. Whether or not you like the current occupant of the Oval Office, he has an awesome array of responsibilities. Even on a slow day, numerous decisions reach his desk. They might involve potential terrorist attacks, a looming epidemic, immigration or air pollution. Facing a criminal prosecution seems fatally incompatible with the president's constitutional role.

Aware of this argument, Rotunda notes that the Supreme Court allowed Paula Jones' sexual harassment suit to go forward against Bill Clinton, notwithstanding Clinton's argument that to do his job, a sitting president needs to have immunity against such lawsuits. Among other things, the Supreme Court answered that trial judges could find ways to accommodate the president's schedule. Why isn't the same thing true for a criminal prosecution?

That's a fair question, but a criminal proceeding is unique, and the problem isn't really about scheduling. Realistically speaking, any White House would be pretty well disabled if the president is under a criminal indictment and faces the prospect of trial and imprisonment.

Rotunda is aware of the risk, and leaves open the possibility that imprisonment itself might be delayed, so that the prosecution would not compete with the impeachment mechanism. But that's hardly sufficient. The question is whether the president's ability to perform his constitutional functions would be impaired by the prosecution itself. There's little doubt that it would.

Does this mean that the president is above the law? Not at all. In cases of serious wrongdoing, and breaches of public trust, the Constitution provides a remedy: impeachment.

It's not only that, look at the banana republic type of meddling going on in Michigan, North Carolina and Wisconsin. The U.S. is going to have a tough time over the next couple of years trying to encourage countries to adopt democratic values, when their own elected officials can't willingly do the same. And that's even before you get to the Trump administration's gutting of the State Department and foreign services

On Friday, federal prosecutors in Manhattan and the special counsel, Robert Mueller, delivered a potentially devastating one-two punch against President Trump. Coming late in the day, they made for bracing end-of-the-week reading.

Calling on the court to impose a sentence of substantial imprisonment against Michael Cohen, the president’s former personal attorney, prosecutors in the Southern District of New York stated that Mr. Trump, the Trump Organization and the campaign were all directly involved in an illegal scheme to silence two women who claimed they had affairs with Mr. Trump. Prosecutors wrote that payments made by Mr. Cohen and other actions were taken “with the intent to influence the 2016 presidential election” and pursued “in coordination with and at the direction of Individual 1” — that is, Mr. Trump.

The Trump Organization’s reimbursements to Mr. Cohen for payments were fraudulently disguised as legal fees — and, according to the memo, were approved by senior executives at the organization. The New York prosecutors also disclosed that they are investigating additional unspecified matters involving Mr. Cohen and, presumably, the Trump Organization. In light of these disclosures, the likelihood that the company and the Trump campaign face charges is now high.

Although President Trump may avoid a similar fate because the Justice Department is unlikely to indict a sitting president, he could be named as an unindicted co-conspirator, as was President Richard Nixon, or charged if he leaves office before the statute of limitations runs out (most likely in 2022).

In crediting Mr. Cohen with providing “substantial and significant efforts” to assist the investigation, Mr. Mueller’s separate sentencing memo details new evidence of collusion with Russia, including a previously unreported phone conversation in November 2015 between Mr. Cohen and an unnamed Russian who claimed to be a “trusted person” in Moscow. The Russian explained to Mr. Cohen how the Russian government could provide the Trump campaign with “political synergy” and “synergy on a government level,” and offered to set up a meeting between Mr. Trump, then a candidate for the Republican presidential nomination, and President Vladimir Putin of Russia.

Mr. Mueller also notes that Mr. Cohen provided his team with additional information relevant to the “core” of the special counsel investigation.

The special counsel focuses on Mr. Cohen’s contacts with people connected to the White House in 2017 and 2018, possibly further implicating the president and others in his orbit in conspiracy to obstruct justice or to suborn perjury. Mr. Mueller specifically mentions that Mr. Cohen provided invaluable insight into the “preparing and circulating” of his testimony to Congress — and if others, including the president, knew about the false testimony or encouraged it in any way, they would be at substantial legal risk.

Mr. Trump’s legal woes do not end there. The special counsel also advanced the president’s potential exposure under the Foreign Corrupt Practices Act for activities relating to a potential Trump Tower Moscow. Mr. Mueller noted that the Moscow project was a lucrative business opportunity that actively sought Russian government approval, and that the unnamed Russian told Mr. Cohen that there was “no bigger warranty in any project than the consent” of Mr. Putin.

If recent reports that Mr. Cohen floated the idea of giving Mr. Putin a $50 million luxury apartment in a future Trump Tower Moscow prove true, both the president and his company could face substantial jeopardy.

In a second blow to the president, on Friday prosecutors also disclosed a list of false statements that Paul Manafort, his former campaign chairman, allegedly made to federal investigators in breach of the cooperation agreement he entered into following his conviction for financial fraud and subsequent guilty plea to criminal conspiracy.

Some of the lies that the special counsel spells out in the redacted memorandum appear to implicate the president and those close to him in possible collusion and obstruction crimes. Notably, Mr. Manafort is accused of lying to the special counsel regarding his contacts with the Trump administration.

We don’t know the content of those contacts, but considering public statements about potential pardons, it is not hard to imagine they could implicate the president and others in a conspiracy to obstruct justice or witness tampering if, for example, they suggested a potential pardon if Mr. Manafort protected the president.

Contrary to the president’s claim that all of this “totally clears” him, the danger to Mr. Trump, his business and his campaign has compounded significantly. For all these reasons, the president is unlikely to have a restful, tweet-free weekend — or a calm 2019, for that matter.

Climate change: COP24 fails to adopt key scientific report

Attempts to incorporate a key scientific study into global climate talks in Poland have failed.

The IPCC report on the impacts of a temperature rise of 1.5C, had a significant impact when it was launched last October.

Scientists and many delegates in Poland were shocked as the US, Saudi Arabia, Russia and Kuwait objected to this meeting "welcoming" the report.

It was the 2015 climate conference that had commissioned the landmark study.

The report said that the world is now completely off track, heading more towards 3C this century rather than 1.5C.

Keeping to the preferred target would need "rapid, far-reaching and unprecedented changes in all aspects of society". If warming was to be kept to 1.5C this century, then emissions of carbon dioxide would have to be reduced by 45% by 2030.

The report, launched in Incheon in South Korea, had an immediate impact winning praise from politicians all over the world.

But negotiators here ran into serious trouble when Saudi Arabia, the US, Russia and Kuwait objected to the conference "welcoming" the document.

Instead they wanted to support a much more lukewarm phrase, that the conference would "take note" of the report.

Saudi Arabia had fought until the last minute in Korea to limit the conclusions of the document. Eventually they gave in. But it now seems that they have brought their objections to Poland.

The dispute dragged on as huddles of negotiators met in corners of the plenary session here, trying to agree a compromise wording.

None was forthcoming.

With no consensus, under UN rules the passage of text had to be dropped.

Many countries expressed frustration and disappointment at the outcome.

"It's not about one word or another, it is us being in a position to welcome a report we commissioned in the first place," said Ruenna Haynes from St Kitts and Nevis.

"If there is anything ludicrous about the discussion it's that we can't welcome the report," she said to spontaneous applause.

Scientists and campaigners were also extremely disappointed by the outcome.

"We are really angry and find it atrocious that some countries dismiss the messages and the consequences that we are facing, by not accepting what is unequivocal and not acting upon it," said Yamide Dagnet from the World Resources Institute, and a former climate negotiator for the UK.

Others noted that Saudi Arabia and the US had supported the report when it was launched in October. It appears that the Saudis and the US baulked at the political implications of the UN body putting the IPCC report at its heart.

"Climate science is not a political football," said Camilla Born, from climate think tank E3G.

"All the world's governments - Saudi included - agreed the 1.5C report and we deserve the truth. Saudi can't argue with physics, the climate will keep on changing."

Many delegates are now hoping that ministers, who arrive on Monday, will try and revive efforts to put this key report at the heart of the conference.

"We hope that the rest of the world will rally and we get a decisive response to the report," said Yamide Dagnet.

"I sincerely hope that all countries will fight that we don't leave COP24 having missed a moment of history."

Special counsel Robert Mueller is closing in on President Trump, according to a journalist who helped expose wrongdoing by former President Richard Nixon that helped lead to the only White House resignation in history.

CNN's Carl Bernstein, who with Washington Post colleague Bob Woodward in the early 1970s broke a series of key stories on Watergate, on Sunday cited a recent sentencing memo regarding Michael Cohen, Trump's former fixer. That could prompt impeachment proceedings against the president, Bernstein said. Federal prosecutors in New York filed the document last week.

"[But] there's something much more important than just impeachment going on, and that is the fact that Donald Trump for the first time in his life is cornered," Bernstein said on CNN's "Reliable Sources". "As a businessman, he always could bully his way out of a corner, he always could buy his way out, cheat his way out. He is boxed in by [Special Counsel Robert] Mueller and the people around him know that he is."

Cohen, who was also Trump's longtime personal attorney, pleaded guilty in August to a range of charges. That included two related to efforts made ahead of the 2016 election to silence two women, including porn star Stormy Daniels, about their alleged extramarital affairs with the president more than a decade ago. The case by the U.S. attorney's office in the Southern District of New York case emanated from a referral by Mueller.

Prosecutors there on Friday recommended Cohen spend a "substantial" amount of time in prison. The court documents also assert that Cohen told prosecutors he had committed the crimes concerning the women "in coordination with and at the direction of individual one," who is widely believed to be Trump.

Cohen last week also pleaded guilty to lying to Congress about a proposed Trump real estate project in Moscow as part of Mueller's ongoing federal Russia investigation.

"It's on the question of collusion, possible collusion with Russia, and unquestionably a massive obstruction of justice that is now demonstrable for all to see, led by the president of the United States to cover up whatever the dealings of himself, his family, his aides were with Russia," Bernstein said Sunday. "We don't know what those dealings were in detail, but it's clear that Mueller is now connecting the dots between a massive obstruction intended to hide the truth about the Trump campaign, Trump, his business organization, and his family, from the investigators. "

Special counsel Robert Mueller is closing in on President Trump, according to a journalist who helped expose wrongdoing by former President Richard Nixon that helped lead to the only White House resignation in history.

CNN's Carl Bernstein, who with Washington Post colleague Bob Woodward in the early 1970s broke a series of key stories on Watergate, on Sunday cited a recent sentencing memo regarding Michael Cohen, Trump's former fixer. That could prompt impeachment proceedings against the president, Bernstein said. Federal prosecutors in New York filed the document last week.

"[But] there's something much more important than just impeachment going on, and that is the fact that Donald Trump for the first time in his life is cornered," Bernstein said on CNN's "Reliable Sources". "As a businessman, he always could bully his way out of a corner, he always could buy his way out, cheat his way out. He is boxed in by [Special Counsel Robert] Mueller and the people around him know that he is."

Cohen, who was also Trump's longtime personal attorney, pleaded guilty in August to a range of charges. That included two related to efforts made ahead of the 2016 election to silence two women, including porn star Stormy Daniels, about their alleged extramarital affairs with the president more than a decade ago. The case by the U.S. attorney's office in the Southern District of New York case emanated from a referral by Mueller.

Prosecutors there on Friday recommended Cohen spend a "substantial" amount of time in prison. The court documents also assert that Cohen told prosecutors he had committed the crimes concerning the women "in coordination with and at the direction of individual one," who is widely believed to be Trump.

Cohen last week also pleaded guilty to lying to Congress about a proposed Trump real estate project in Moscow as part of Mueller's ongoing federal Russia investigation.

"It's on the question of collusion, possible collusion with Russia, and unquestionably a massive obstruction of justice that is now demonstrable for all to see, led by the president of the United States to cover up whatever the dealings of himself, his family, his aides were with Russia," Bernstein said Sunday. "We don't know what those dealings were in detail, but it's clear that Mueller is now connecting the dots between a massive obstruction intended to hide the truth about the Trump campaign, Trump, his business organization, and his family, from the investigators. "
