Just over half of voters want President Trump impeached and removed from office, according to a Fox News Poll released Wednesday.

A new high of 51 percent wants Trump impeached and removed from office, another 4 percent want him impeached but not removed, and 40 percent oppose impeachment altogether. In July, 42 percent favored impeachment and removal, while 5 percent said impeach but don’t remove him, and 45 percent opposed impeachment.
These numbers are incredible, for a process that’s only just started.  And it’s not like anything he’s doing right now is likely to reduce them.

He told a long-winded story yesterday about "people that were smiling saying, 'Oh Mr. President, thank you for being here'” when he visited Dover Air Force Base in the past to greet the coffins of returning deceased American soldiers.

“I’ve seen people that I thought were really incredible the way they were, I didn’t even understand how they could take it so well, scream like I’ve never seen anything before,” Trump said. “Sometimes they’ll run to the coffin. They’ll break through military barriers, they’ll run to the coffin and jump on the coffin.”

“Crying mothers and wives, crying desperately,” Trump said. And he went on and on and on with an increasingly dramatic story of what he'd seen.

The key line: "Sometimes I call the parents. Sometimes I see the parents. I go to Dover when I can."

Care to guess how many times Trump has gone to Dover to greet coffins in his 34 months as President?

WASHINGTON – The late Chief Justice William Rehnquist was a busy man on Jan. 20, 1999. The impeachment trial of President Bill Clinton was in its second week, and Rehnquist had to stop presiding over an oral argument at the Supreme Court, cross the street, and preside over the Senate.

One of the lawyers arguing before the high court that day was John Roberts. Once one of Rehnquist's law clerks at the high court, Roberts could be juggling the same two jobs as his former boss soon.

If President Donald Trump is impeached by the House of Representatives and tried by the Senate, it will be Roberts, nominated by President George W. Bush to succeed Rehnquist as chief justice in 2005, running the show. Those who know him best say he's a perfect fit for the job.

"I've argued in front of him 39 times, and I think what comes across is that he cares deeply about institutions," says Neal Katyal, a former acting U.S. solicitor general who, like Roberts before him, heads appellate litigation at Hogan Lovells.

Like Rehnquist – who once quipped that as the Clinton impeachment trial's presiding officer he "did nothing in particular and did it very well" – Katyal says Roberts would "work hard to be scrupulously fair in carrying out a unique constitutional function."

Roberts, 64, this week began his 15th term as chief justice of the United States with a bang. The high court heard three major civil rights cases that will determine if gay and transgender people are protected by a 1964 federal law barring employment discrimination based on "sex."

In the next few months, his day job will include hearing cases on abortion, immigration, religion and gun rights, all on the eve of the 2020 presidential election.

What's more, Roberts now sits in the middle of the Supreme Court figuratively as well as literally. With the retirement of Associate Justice Anthony Kennedy last year, he has become the closest thing to a swing vote between four conservative and four liberal justices.

Roberts' last tango with the Senate came in 2005, when he defined the chief justice's role as that of an umpire calling balls and strikes en route to his 78-22 confirmation. Since then, he has tried to keep the Supreme Court out of politics – not always with success.

When Trump criticized an "Obama judge" last year over an immigration ruling, Roberts issued a rare rebuke. "We do not have Obama judges or Trump judges, Bush judges or Clinton judges," he said. "What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them."

During an appearance in New York City late last month, Roberts said that appraisal applies to the justices as well.

“When you live in a politically polarized environment, people tend to see everything in those terms," he told about 2,000 people at Temple Emanu-el in Manhattan. "That’s not how we at the court function.”

In absentia, it would be Trump appearing before Roberts in a Senate impeachment trial, but the chief justice's role is more umpire than judge or jury. The Senate would acquit or convict the president; Roberts would rule on procedural matters and might break tie votes, but not on conviction, which requires a two-thirds majority of the 100-member Senate.

“I believe his presence would have a positive influence on the tenor of any debate,” says Walter Dellinger, a former acting U.S. solicitor general during the Clinton administration who argued the other case before the Supreme Court on Jan. 20, 1999. He recalls the marshal advising the advocates that Rehnquist would be leaving promptly at 11:50 a.m., and "not to take it personally."

"It would be fortunate to have Chief Justice Roberts preside over an impeachment trial, because I think he’ll be perceived to be fair and restrained," Dellinger says.

Live television

Restraint might be difficult in the current political environment, however. Richard Lazarus, a Harvard Law School professor and Roberts' roommate when both were students there in the 1970s, says Senate Democrats and Republicans worked together to set rules for the Clinton trial. That may be harder this time around.

“He knows that when he crosses First Street, he's going to be putting himself right in the middle of the workings of the political branch," Lazarus says. "He’s going to work hard to keep above the fray.”

In addition to partisan rancor, Roberts also would have to get used to being on live television – "the very thing that all the justices, certainly the chief, have not wanted to happen in the Supreme Court," Lazarus says.

There was no live TV in 1868, when Chief Justice Salmon Chase presided over the Senate's first impeachment trial of President Andrew Johnson. That was a good thing for Chase, who had two of his procedural rulings overruled.

Rehnquist did not meet that fate in the Senate's second impeachment trial, but his most significant ruling was to stop House members serving as managers, or prosecutors, from calling senators "jurors."

In a third Senate presidential impeachment trial, Roberts similarly would hope to avoid substantive rulings, Dellinger says. But he could be drawn into disputes over the admission of evidence or other matters.

"While they may be overturned by the vote of the Senate," Dellinger says, the chief justice's rulings "nonetheless would come with some moral force.”

If it comes down to the rule and application of the law rather than a simple vote, then Trump's toast.

If Trump is adjudged to have acted illegally and unconstitutionally, even if that ruling cannot be applied directly, it puts the GOP in a very awkward position if they want to ignore it and vote for aquittal.

Trump Urged Top Aide to Help Giuliani Client Facing DOJ Charges

President Donald Trump pressed then-Secretary of State Rex Tillerson to help persuade the Justice Department to drop a criminal case against an Iranian-Turkish gold trader who was a client of Rudy Giuliani, according to three people familiar with the 2017 meeting in the Oval Office.

Tillerson refused, arguing it would constitute interference in an ongoing investigation of the trader, Reza Zarrab, according to the people. They said other participants in the Oval Office were shocked by the request.

Tillerson immediately repeated his objections to then-Chief of Staff John Kelly in a hallway conversation just outside the Oval Office, emphasizing that the request would be illegal. Neither episode has been previously reported, and all of the people spoke on condition of anonymity due to the sensitivity of the conversations.

The White House declined to comment. Kelly and Tillerson declined to comment via representatives. Another person familiar with the matter said the Justice Department never considered dropping the criminal case.

Zarrab was being prosecuted in federal court in New York at the time on charges of evading U.S. sanctions against Iran’s nuclear program. He had hired former Attorney General Michael Mukasey and Giuliani, who has said he reached out repeatedly to U.S. officials to seek a diplomatic solution for his client outside the courts.

The president’s request to Tillerson -- which included asking him to speak with Giuliani -- bears the hallmarks of Trump’s governing style, defined by his willingness to sweep aside the customary procedures and constraints of government to pursue matters outside normal channels. Tillerson’s objection came to light as Trump’s dealings with foreign leaders face intense scrutiny following the July 25 call with Ukraine’s president that has sparked an impeachment inquiry in the House.

The episode is also likely to fuel long-standing concerns from some of Trump’s critics about his policies toward Turkey and his relationship with its authoritarian president, Recep Tayyip Erdogan. Zarrab’s release was a high priority for Erdogan until the gold trader agreed to cooperate with prosecutors in New York.

It isn’t clear whether Trump considered his request for Tillerson to intervene to be improper or was just testing the bounds of what he could do as president on an issue that could provide diplomatic benefits while also helping Giuliani, a longtime supporter. The Oval Office meeting occurred in the second half of 2017 and Giuliani wasn’t the president’s personal lawyer at the time, as he is now.

In a phone interview this month, Giuliani initially denied that he ever raised Zarrab’s case with Trump but later said he might have done so. He said he’d been speaking with U.S. officials as part of his effort to arrange a swap of Zarrab for Andrew Brunson, an American pastor jailed in Turkey who was later released in 2018.

“Suppose I did talk to Trump about it -- so what? I was a private lawyer at the time,” Giuliani said. “Maybe I’m wrong. Maybe at some point I dropped his name in a conversation. Or maybe one of his people talked to him about it because I was trying to do a prisoner swap.”

Giuliani said he discussed the Zarrab case with State Department officials and disclosed that two years ago, although he declined to say if he ever spoke directly to Tillerson about the case, saying “you have no right to know that.”

Concerns about Trump’s close alliance with Erdogan were exacerbated this week after Trump abruptly announced on Sunday that he would clear U.S. troops from the path of a planned Turkish invasion in northeast Syria. The weekend announcement drew quick criticism from top Republican lawmakers, who said it endangered Kurdish forces the U.S. relied on to defeat Islamic State. Those Kurdish-led forces are now under attack.

Trump followed his weekend decision with an announcement Tuesday that he has invited Erdogan to the White House in November.

As he was with Ukraine, Giuliani was so steeped in events in Turkey that State Department officials grew increasingly alarmed. Earlier in 2017, he had traveled to the country and met with Erdogan as part of his effort to seek a resolution in Zarrab’s case.

He and Mukasey said in a letter to the judge in Zarrab’s case that they notified then-Attorney General Jeff Sessions of their plans before holding a meeting with Erdogan.

Erdogan repeatedly spoke with Trump and, before 2017, Obama administration officials about Zarrab’s case when it was before the Southern District of New York as part of a broader investigation into a scheme to evade sanctions on Iran.

At one point, the State Department under Tillerson got involved in discussions over possibly swapping Zarrab for Brunson, the jailed pastor, but the matter was eventually dropped because Turkey kept escalating its demands, according to another person familiar with the timeline of events.

Tillerson has said publicly that the president frequently asked him to do things that were illegal.

“So often, the president would say ‘Here’s what I want to do and here’s how I want to do it,’ and I would have to say to him, ‘Mr. President I understand what you want to do but you can’t do it that way,”’ Tillerson said in an on-stage interview with Bob Schieffer in Texas last year. “It violates the law, it violates treaty you know and he just, he got really frustrated when we’d have those conversations.”

Zarrab, a one-time gold trader in his mid-30s, had lived an opulent lifestyle in Turkey, with a private plane, yacht and a Turkish pop-star wife. After his arrest in early 2016, prosecutors alleged he had “close ties” with Erdogan. They accused Zarrab of using his network of companies to move money through the U.S. financial system to help Iran evade sanctions as the U.S. was stepping up economic pressure on the country.

Zarrab later pleaded guilty and testified against Mehmet Hakan Atilla, who headed international banking at state-owned Turkiye Halk Bankasii AS, known as Halkbank. Zarrab said Erdogan knew of and supported the laundering effort on behalf of Iran. Erdogan and other senior Turkish officials repeatedly rejected the accusations, saying they were fabrications.

Atilla was eventually convicted of helping Iran evade economic sanctions on billions of dollars of oil revenue and served 28 months in U.S. prison before returning to Turkey in July to a hero’s welcome. Turkey has so far managed to avoid U.S. penalties over the sanctions-evasion scheme.

Despite Erdogan’s demands and Giuliani’s efforts, Zarrab was never sent back to Turkey. Once he agreed to testify, he was moved to a county jail for safekeeping, and he stayed there until after Atilla’s trial was over. By then, Zarrab’s home and assets in Turkey had been seized by Erdogan.

Well this seems significant, part of the charges against Parnas and Fruman relate to funneling illegal contributions to a US Congressman and seeking his aid in getting Ambassador Yovanovitch removed.

(Now former) Congressman is Pete Sessions, who got $3m from a Trump SuperPAC.

I really hope this tears the Republican Party apart.  At this rate, the only people who will oppose impeachment will be Trump's core base - only about 35% of the electorate, but about 85% of GOP voters.  And at some point I am now fully expecting somebody in the intelligence services to take Mitch McConnell to one side and quietly say, "either you deal with this lunatic or we will".
