Anyone work in Human Resources??
« on: March 29, 2012, 05:21:31 pm »
I am contracted to 40 hours a week but have been off for the past 6 months on ssp with personal problems, I am owed 17 days accrued holiday, work have acknowledged this.

Do they have to pay me my holidays at my working rate of pay or ssp rate?

I have googled this and can't seem to find an answer.

Cheers.

Depends what their policy/your contract says.

I'm assuming they run from April to April?

It doesn't matter what is in your contract to a degree.  Your employer has to, by law, afford you the opportunity to take your leave, namely 28 days per year, including bank holidays.

They should not pay you for them at all, as that is not giving your statutory leave entitlement and they would be breaking the working time directive.  You should be made to take them.  That said, some employers do do it and if they are going to pay you it's at your pay rate, not SSP.
