Emiliano Sala: Cardiff set to claim transfer deal 'not legally binding'

Cardiff City are set to claim the deal to buy Emiliano Sala from Nantes for £15m was not legally binding.

The Bluebirds are refusing to make interim payments for the striker, who died in a plane crash on 21 January.

Cardiff will tell world football's governing body Fifa that Nantes' conditions for completion of the deal were not fulfilled and Sala was not registered as a Premier League player.

Nantes claim the required paperwork was completed.

The French club referred the matter to Fifa, who want Cardiff to submit their evidence by 3 April.

Sala, 28, was Cardiff's record signing, announced on Saturday, 19 January.

The Argentine died when an aircraft piloted by David Ibbotson, who is still missing, crashed into the English Channel near Guernsey.

The club was due to pay a first instalment on 20 February.

A Cardiff source said the transfer agreement stipulated - at the request of Nantes - that the Football Association of Wales and France's Ligue de Football Professional had to confirm the registration to both clubs by 22 January, along with confirmation of the international transfer certificate being released.

The Premier League also had to clear the registration.

The Bluebirds insist the terms of the contract maintains that if any parts of that arrangement were not confirmed, then the deal would be null and void.

They claim:

Ligue de Football Professionel had not contacted Cardiff either before or after 22 January.

The FAW did not confirm with Nantes.

The Ligue de Football Professional did not confirm with Nantes until 25 January.

It is thought the notifications clause was inserted because if the deal fell through, both Cardiff and Nantes would have had time to seek a new player before the January transfer window closed on 31 January.

BBC Sport has also learned arrangements for a signing-on fee did not meet Premier League rules and so had been rejected by the league.

A Cardiff spokesman would not comment on specific details but said: ''The club is aware of Fifa's request for a response by 3 April and is processing that accordingly. We have no further comment at this stage.''

Nantes say they completed all the necessary paperwork and have pointed out Fifa registered the international transfer certificate on 21 January.

They say they have been fully compliant with Fifa's rules.

It's extremely unlikely to be linked, but a body was found in the sea by a fisherman off Portavogie harbour this morning. Fingers crossed its David Ibbotson and his family have closure. But as I said, extremely unlikely to be linked.

Saw a good suggestion by someone on twitter, both Cardiff and Nantes  should split the fee 50/50 and give the money to his family.

That still means Cardiff pay out £15m which it looks like they are trying to get out of.
Unless the suggestion is each pay £7.5m to the family themselves and drop any transfer, in which case Nantes are £22.5m down (£15m owed and the £7.5 to the family).

Nantes also owe Bordeaux a sell on fee.

None us know the ins and outs of this. We don`t know the contractual arrangements, insurance issues and no doubt a whole host of other matters yet to be highlighted.

That said, as RedK has just posted, it is all just very sad. Squabbling about money in these circumstances just seems so wrong to all of us.

Came across the photo by accident earlier on social media made me feel sick wasn't even sure what I was looking at, at first.

Hopefully the person who released it gets a long time in jail.

The woman, of Corsham, Wiltshire was also arrested on suspicion of malicious communications, and has been released on conditional bail.

The man, from Calne in Wiltshire, has been released under investigation.

Wiltshire Police said: "There is no evidence to suggest a break-in at the mortuary, and no evidence to suggest that any staff from the mortuary, or indeed any other council employees, are involved in any wrongdoing."

A post-mortem examination on Sala was conducted on 7 February at Holly Tree Lodge Mortuary in Dorset.

Dorset Police began an investigation on 13 February when the force became aware of the image on Twitter, which was swiftly removed, but had been circulated extensively on various social media sites.

Det Insp Gemma Vinton, senior investigating officer for Wiltshire Police, said: "During the course of this ongoing investigation we have been liaising with the Crown Prosecution Service Wessex.

"A file of evidence was sent to the CPS last week to consider whether criminal charges should be brought again the two individuals under investigation by Wiltshire Police.

"My thoughts remain with Emiliano's family for the pain they have endured throughout the last three months, and who should not have to go through the additional anguish of knowing such distressing images have circulated on the internet.

"I would also urge people to stop sharing the image - this is causing further distress to Emiliano's family and friends."

The Argentine striker had been travelling to his first training session at Cardiff City after completing a £15m club record move from Nantes FC, when the Piper Malibu plane crashed on 21 January.

The body of the pilot, David Ibbotson, from Crowle, North Lincolnshire, has not been found.

"Beyond the human tragedy that affected the entire sports community with the death of Emiliano Sala, Fifa has just reminded that the legal security of the commitments made by clubs in the context of player transfers must be respected.

"It is not a surprise, it confirms the position that FC Nantes has held for the last nine months: Emiliano Sala signed with Cardiff; his contract with Nantes was over; the international transfer contract (ITC), delivered by Fifa, states that on the day of the accident Emiliano was indeed a Cardiff player."

Cardiff believe the transfer was null and void, saying the Premier League had rejected certain clauses requested by Nantes in the original contract and that Sala never had a chance to review or sign the final version, meaning their record signing was not registered as a Premier League player.

A statement from Fifa read: "Cardiff City FC must pay FC Nantes the sum of 6m euros, corresponding to the first instalment due in accordance with the transfer agreement concluded between the parties on 19 January 2019 for the transfer of the late Emiliano Sala from FC Nantes to Cardiff City FC.

"The sum of 6m euros corresponds to the first instalment currently due in accordance with the contract. For confidentiality reasons, we cannot comment at this stage on potential future instalments or other conditions of the transfer agreement."

Cardiff, who were relegated to the Championship at the end of last season, and Ligue 1 Nantes have 10 days should they wish to appeal to the Court of Arbitration for Sport in Lausanne.

"Cardiff City FC acknowledges the decision announced today by Fifa's players status committee regarding the transfer of Emiliano Sala. We will be seeking further clarification from Fifa on the exact meaning of their statement in order to make an informed decision on our next steps," read a Cardiff statement.

The plane carrying Sala and pilot David Ibbotson, 59, crashed in the English Channel on 21 January, two days after the players' transfer was announced.

The footballer's body was recovered from the wreckage, but Ibbotson, from Crowle, North Lincolnshire, has still not been found.

Sala was exposed to high levels of carbon monoxide prior to the crash, a report later revealed.

Cardiff City will appeal to the Court of Arbitration for Sport against Fifa’s ruling that they must pay Nantes the transfer fee for Emiliano Sala, the 28-year-old Argentinian player tragically killed in a plane two days after Cardiff announced his signing on 19 January.

On Monday Fifa’s players’ status committee, which determines disputes relating to international transfers, found against Cardiff, ordering the club to pay the overdue first €6m instalment of the €17m total payable over three years, which was agreed with the French Ligue 1 club.

Cardiff had refused to pay the transfer fee after Sala died, arguing that as there were details in the club’s employment contract with him which were still to be concluded, the transfer had not been finalised. The Fifa committee, chaired by the South African lawyer and senior football administrator Raymond Hack, determined that the transfer from Nantes had been agreed by Cardiff and all necessary elements of the paperwork concluded, just hours before the plane crashed on 21 January, so Cardiff are legally obliged to pay the agreed fee.

In a statement on Wednesday morning, Cardiff said the club was “extremely disappointed” with the Fifa committee’s decision and would appeal to Cas. The ruling was reached “on a narrow aspect of the overall dispute”, they argued, without considering all the documentation.

“There remains clear evidence that the transfer agreement was never completed in accordance with multiple contractual requirements which were requested by Nantes, thereby rendering it null and void,” Cardiff said.

Following the ruling on Monday, Nantes’ lawyers Jérôme Marsaudon and Louis-Marie Absil told L’Équipe that “justice is done” and accused Cardiff of acting in “bad faith” and exploiting Sala’s death to avoid payment. The lawyers said that the ruling meant Cardiff would be liable for the next two instalments when they are due on 1 January 2020 and 2021, but that they expected Cardiff to take the argument to Cas, as did Fifa.

“We can imagine that Cardiff will continue the legal battle,” the lawyers said. “It can last if Cardiff wants it to last. That is what they have been doing since the beginning of this case. They use any pretext, up to the death of a man, to not respect their commitments. When you have creditors in bad faith, you cannot prejudge the time of the proceedings to reach a final decision.”

Cardiff reject the accusation that they are acting in bad faith, maintaining that there is a legal question over the validity of the transfer, as it had been a condition of Nantes’ that Sala’s own contract with Cardiff had to be finalised by 22 January.

Fifa’s committee considered the completion of the relevant paperwork for the transfer of Sala to Cardiff, who wanted to sign a striker in the January window to help them avoid relegation from the Premier League. The former agent Willie McKay and his son Mark, who is a current registered agent, worked on the transfer on behalf of Nantes, who gave Mark McKay a mandate to sell the player to a UK club for 10% of the agreed fee.

Cardiff publicly unveiled Sala as their record signing on 19 January, and at 3:32pm that day, according to France’s Ligue de Football Professionel, Nantes uploaded the transfer agreement onto Fifa’s TMS international transfer registration system. Forty minutes later, the transfer of Sala to Nantes was “matched” on TMS, which meant that the necessary international player certificate (ITC) could be requested by the Football Association of Wales (FAW).

On 21 January the FAW did request the ITC from the French FA via the TMS system; the French FA is said to have checked with its league that this was in order, then having been told that it was, sent the certificate to the Welsh FA, at 5:14pm. The FAW is said to have acknowledged receipt of the certificate at 6:30pm (5:30pm UK time), which is the final step to conclude an international football transfer according to Fifa’s regulations.

Sala had been flown to Nantes from Cardiff to say his farewells, but the Piper Malibu light aircraft carrying him crashed into the Channel at 8:16pm that night, 21 January, on the return flight to Cardiff, less than three hours after the official conclusion of his transfer to the Premier League. Investigators have since said that Sala may have died because of carbon monoxide poisoning, and that the pilot, Dave Ibbotson, 59, was likely to have been similarly exposed to the gas leaking into the plane, although his body has never been found.

This is just sad.

Don`t understand how a club can spend so much money on a player and not arrange transport to ensure his safe passage. Cardiff were really lax on this.  Really sad for his family and all involved.
