GP practices in England have been instructed to hand over their patients’ entire medical histories with just six weeks’ notice. Like many GPs, I’m very concerned about the implications this has for my patients. A growing number of us in London have taken taken the decision to pull the plug on the new data-sharing programme with NHS Digital and refuse to hand over patient records.

This data grab is unwarranted, unparalleled in its scale and implications and quite possibly unlawful. Yet NHS Digital, acting at the government’s request, has downplayed the significance of the move. There has been no public awareness campaign, so you’d be forgiven for not knowing that your consent is assumed, or that you have only until 23 June to opt out from having your GP data extracted.

What this means in practice is that all your GP interactions, starting from the time you were born (and including many of the most intimate details of your life) are at risk of being indirectly sold to corporations. To be specific, your GP data includes details of physical, mental and sexual health, drug and alcohol history, and any family and work-related problems that you thought you’d disclosed in confidence. What’s worse, your personal information will not be fully anonymous, meaning it is relatively easily identifiable as yours (you can opt out after 23 June, but NHS Digital holds on to whatever data it has obtained, and still makes it available to third parties).

We’ve been here before. A national programme launched in 2013 to extract GP medical records, “care.data”, was scrapped following concerns about the security and confidentiality of “pseudonomised” data sharing and a lack of clarity and transparency about who could access this data and how it would be used. In 2016, Google DeepMind established a data-sharing agreement with the Royal Free hospital in London. The hospital was found to have failed to comply with the Data Protection Act in handing over the personal information of 1.6 million patients without adequately informing them. But rather than learning from past scandals such as these, the government has instead decided to pursue this data grab by stealth, under the cover of a pandemic.

Our health data has the potential to save lives. GP patient records are the single richest and most valuable source of this kind of information. Artificial intelligence and medical research companies can use health data to train machine-learning algorithms that can detect patterns, diagnose patients and identify new avenues for treatment. But this can be a mixed blessing, depending on how the data – and the products made with it – are used. Research and development depends heavily both on public data and public funding, but if the tools developed using our health records aren’t made publicly available, then not only have we handed over our health data for free; many people won’t even be able to access the treatments and innovations developed using it.

Personal health information should be held in trust and put to good use in the public interest, be it tailoring local services, improving public policy or driving research and development for publicly available treatments. But it is open to abuse when it’s mishandled. NHS Digital has developed a highly secure “Trusted Research Environment” that provides researchers with safe access to data, without sending out copies. Why, yet again, is the government choosing not to use it?

This latest data grab is symptomatic of the lack of representation, transparency, and accountability within both Whitehall and NHS England. We desperately need a public conversation about the influence corporations are exerting on ministers and political processes, and what this means for democracy. Greensill’s lobbying of the head of NHS England is just the latest example of the problem of corporate capture at the heart of our health service.

For now though, if you are registered with a GP in England, you have less than three weeks remaining to opt out of GP data sharing for purposes beyond your direct care (should you decide to do so, you can opt back in at any time). At minimum, the government should extend its notice period from four weeks to six months so GPs can inform our patients and provide them with relevant guidance. I’d urge that our health data is only ever used within the NHS “Trusted Research Environment”, with full transparency over how it is used.

Our GP records are an extension of who we are. To treat them with the care and respect that they warrant is to treat us with care and respect. Personal health data should be used in an informed manner and in the public interest, not exploited for corporate profits. It is precisely with this in mind that GPs like me are refusing to comply with this programme. We encourage our colleagues throughout England to join us. The NHS is founded on the trusting relationships between doctors and their patients. It should never be used as a logo for ministers to shield corporate greed.

Done correctly, this is a very powerful tool for public health. 

Done incorrectly, it will enable insurers to load premiums, or even identify high risk individuals from poorly anonymised data

Trying to ‘sneak’ this through on the quiet by all accounts.  Not straight forward to opt out either it appears unless folk know how to.

Should be down to the individual whether to share (sell?) their own personal data to third parties (private companies).

Tory NHS Data Grab - Opt out deadline 23rd June 2021
This definitely needs a separate thread because as the deadline to opt out approaches it is being discussed in different threads and there seems to be some confusion over what is at stake and how the opt out works.

In short there are TWO steps you need to take to opt out completely:
  • 'Type 1 Opt Out' covers GP data
  • 'Type 2 Opt Out' covers non-GP data (e.g. hospital treatments)
The Type 2 opt out can be done online and is reasonably simple if you have your NHS number (the 10 digit one with no letters). If you don't know your number the GP will have it or you can register with the Government Gateway to have it emailed to you. If you have kids under 13 however, and you want them to be included in the opt out, you need to download a form and post it to NHS Digital.

The Type 1 opt out requires you to print out a hard copy of the opt out letter that has been linked and then post it or drop it off at your GP surgery.

For those who don't remember they already attempted to do this in 2014 but were thwarted due to the public reaction and the actions of MPS (including Tories).

The instructions and sample form from MedConfidential who have been campaigning on this since 2013 seems to be as  good as any:

For the avoidance of doubt:
  • NHS data can already be used for valuable medical research and is governed by strict safeguards.
  • Your data will not be anonymous - it is 'anonymised' which means details can be recovered by interested/unscrupulous operators

This move seems to be more to do with allowing third parties to access data in order to aid NHS 'planning'. By all accounts Government has been using COVID to pave the way for companies like Palantir to get into the NHS (short piece on Palantir from the BBC https://www.bbc.co.uk/news/business-54348456).

According to this surgery bulletin NHS Wales is not going to be using GP information in the way that it will be used in England - the Type 1 opt out would not be required if this is the case:

I think there is a separate form for children which covers the Type 2 opt out:

Following link says ‘choice’ (opt out or otherwise) doesn’t apply to NI, Scotland and Wales (see last paragraph under the initial section ‘Overview’).  However, neither does it clarify what Health administrations in those locations will do if anything, ie does this not impact the regions at all or will same happen at a later date or does some sort of default position apply (status quo or otherwise)?

Agree. It is far from clear although one would hope that a change to the status quo would require consultation and legislation which you might expect the Scots and Welsh to be more open about.

I just bunged a bit of cash at this crowdjustice campaign which is seeking an injunction to kill the 23rd June deadline and seek meaningful patient consent:

The case is a being bought forward by coalition that includes Just Treatment, Doctors’ Association UK, the Citizens, Open Democracy, the National Pensioners Convention and David Davis MP (who campaigned against the last attempt). As it stands they have £17k of the £40k they think they will need.

The UK government is being threatened with legal action if it does not pause plans to collate the full medical histories of 55m patients in England into a single database from July 1.

In a pre-action letter sent on Friday on behalf of five organisations and Conservative MP David Davis, the campaigners warned that “rushing this major change through with no transparency or debate violates patient trust, and that doing so without patient consent is unlawful”.

Last week, NHS Digital, which runs the health service’s IT systems, confirmed the plan to pool medical records from every patient in England who is registered with a GP clinic into a single database that will be available to academic and commercial third parties for research and planning purposes.

Patients have until June 23 to opt out by filling in a form and taking it to their GP for themselves, and their children, before their historical records become a permanent and irreversible part of the new data set. Patients who opt out after the deadline can stop future data from being funnelled into the new system.

If NHS Digital does not extend the opt-out deadline of June 23, the coalition, which includes the National Pensioners Convention and the Doctors’ Association UK, plans to sue the Department of Health and Social Care as soon as next week, to freeze the data-sharing scheme immediately.

The group, which is supported by tech justice non-profit organisation Foxglove, said that the speed of the process “gives patients no meaningful chance to opt out and excludes older people and others who may not be online”.

It also says that any given consent will have meaning only if the government is clear on which third parties will have access to the data, and for what purposes.

“GPs were barely informed of this major change — how are patients expected to know about it? [We] support safe, consensual uses of patient data, including for health research. But we want to see it done in a way that . . . won’t erode the relationship between clinician and doctor,” said Dr Rosie Shire, a GP at Doctors’ Association UK.

“Patients need to give informed consent to their data being used. We can’t see why the government won’t do this in a less rushed and more transparent way.”

Davis, the MP who has historically campaigned against the Care.data programme, a failed attempt in 2013 to extract GP records into a central database, said: “My constituents don’t expect when they sit down with their family GP that their sensitive health data is going to be able to be accessed by all and sundry. I support a future-fit NHS but it’s got to be done in a way everyone can trust.”

The GP records, which include sensitive information regarding mental health, abuse and criminal records, will be assigned pseudonyms before being shared, which means details that directly identify patients, such as their names, will be replaced with unique codes in the new data set. However, the NHS will hold the keys to unlock the codes “in certain circumstances, and where there is a valid legal reason”, according to its website.

NHS Digital said: “We expect GPs to be ready to implement this new system from July 1, which will provide benefits to patients across England, and are ensuring support is in place to enable them to do this.”

It added: “Understanding patient data saves lives. Sharing GP data has been integral in identifying medical evidence and treatment, including . . confirming the safety of vaccines, and investigating links between medications and cancer risk.”

The coalition also includes medical campaign group Just Treatment, advocacy group the Citizens, and media organisation openDemocracy.

Was just about to post this.

I got a bit of a pile on when I suggested that vaccine passports might be a bad thing because it would mean giving the likes of Dido Harding access to personal data.  The thought that she's going to be in charge of the NHS and therefore have access to everyone's medical records is chilling.

They did this in Australia in the same way.  Only 10% opted out in the end.  Massive impact there was that so few knew about it.  Anecdotal for sure but I'd say 90% of the people I talked with about it had never even heard of it.

That's the crux.

If there were cast-iron, constitutional guarantees that the data would NEVER be made available to ANY private company, I'd have far less of a problem.

A Tory, a worker and an immigrant are sat round a table. There's a plate of 10 biscuits in the middle. The Tory takes 9 then turns to the worker and says "that immigrant is trying to steal your biscuit"

Given how successful the conspiracy loons have been with social media campaigns (Covid, 5G, anti-vaxxers generally, etc), they've been remarkably quiet on this topic.

Almost as if the conspiracy campaigns are funded and directed in the background by big business and millionaires.

NHS plan to share GP patient data in England delayed to September

Good news, of course. Hopefully in the next couple of months they will spell out the details of what they want to do with the data that they can't do already and be more explicit about the purposes and protections which clearly have not been thought through.

It is interesting to note that this has only happened due to pressure from patients, GPs and health professionals so we will need to keep on our toes.
