The rehab hospital only keep you in for a short period, give you a program and let you go . I don’t know if that will change in the future with the new build , I work at the back of it , very impressive job. If he didn’t go to Sheffield for rehab he would only be fit for a nursing home here , poor bloke only went out to enjoy a match and now him and his family’s lives are ruined.

I’ve not read too much into this recently, and just caught up on a bit of stuff concerning it.

Seems that it’s unlikely Sean will ever walk again, meanwhile Simone Mastrelli has been sentenced for 3.5 years for a section 20 assault inflicting GBH.

The reason that he wasn’t tried for section 18 GBH which would have carried a higher sentence is, according to the CPS;

‘It would have been extremely difficult if not impossible to convince a jury of the intention to cause really serious harm’

The logic for that is that there’s only one punch rather than a sustained attack. I’m just not sure that washes, he’s punched him hard in the head, what exactly is the intention when punching someone in the most sensitive area of their body if it isn’t to cause serious harm?

Ive been the victim of sustained attacks on my head and thankfully got away with bruising and a black eye, and unsurprisingly the police did absolutely fuck all about it despite clear video evidence showing the attack.

I really think this country needs to fucking move forward with how stuff like this is dealt with, because a Situation where you can smack someone in the head for no reason (whilst your mate is coming at the with a belt) levy them with brain injuries so severe that they’re not able to walk again, and then escape the most serious punishment because apparently there was no intent to cause serious injury, is frankly fucking ridiculous.

It is unbelievable how that scumbag got away with such a low sentence thanks to the CPS, it really beggars belief that the more serious charge couldn't be brought against him with the option of a Section 20 GGBH assault being available to the jury if they found that the Section 18 GBH wasn't proved. Although as you have clearly pointed out, how could they find any other verdict other than section 18 GBH.

This is a difficult one. Obviously nobody should be injured as badly as Sean was.

People get smacked in the face every Saturday night etc. and although it may be painful, it's thankfully rarely serious.
So would you want to sentence people for their actions or the unintentional outcome of their actions?

But turn it round a bit. If a guy punches a woman in the face then it would be deemed to be much more serious than if he punched a guy. That's fair enough in a way but then why not have the same outcry when a guy in his 50s gets struck?

For me anyone who lifts their hand and strikes out at an innocent victim deserves to be locked away for several years. Normal people do not pick their victims and jump them without warning. It's not acceptable and it's time this type of random action is punished severely.

People go to matches to enjoy the game. Those who go to matches with the intent of lashing out at opposing fans should be stuck in jail for a very long time.

My housemate works for the CPS and has looked at the sentencing guidelines for GBH (this is what he pleaded guilty to according the BBC) and feels that it has been put as a category 2 which has a starting point of 6 years and could be brought down to 3.5 with a guilty plea. However cat 1 would have a starting point of 12 years before being brought down by a guilty plea.

Either way, absolutely anyone can complain that they feel the sentence is too lenient by writing to the Attorney General. You can find the details on how to do this here

I posted this in February. If you're not happy with the length of the sentence and feel that it should be longer then you can write to the Attorney General to ask them to review the case.
