Eddie ran business selling garden ornaments from his smallholding, Keeper’s Cottage. Adjacent to Keeper’s Cottage is a plot of land on which there stands a derelict barn owned by Tom. Tom was planning on demolishing the barn and building new accommodation for his pigs. In the meantime the barn has been boarded up and secured with an electric fence.

In 1992 Eddie removed the boarding and electric fence, which he discovered was broken. He began to store his surplus garden ornaments in the barn. In 1993 he repaired several holes in the roof and, after reports of local thefts, he decided to secure the barn by installing a new electric fence and video camera. He also installed a water supply to ensure that he could clean the ornaments and barn. When Tom’s friends told him about Eddies’ activities he said that he did not mind Eddie making temporary use of the barn.

At the start of 2005 Tom had sufficient savings to build up his new pig sheds. He therefore wrote to Eddie asking him to leave. Eddie refused.

Advise Eddie.

Briefly indicate, if at all, how your advice would differ if title to Tom’s plot of land had been unregistered

Sounds like overriding interests and prescription to me, mate.

Haven't got time to look at thjs now but I'll see what I can do later.

In the meantime hit Megarry and Wade (is that still the leading Property book?)

Yep. Basically, you can claim ownership of something after a certain length of time if you are not booted out.

IANAL, but I thought it was about 15 years for property. It's 10 for land, or it certainly is if you can occupy part of an adopted highway for that length of time.

After the time period has elapsed, you can register the land in your name. If it is already registered, then the LR will write to the Title Holder and give them notice of what you are doing.

If it is unregistered, they cannot.

(Mate, you really shouldn't be taking my advice in this!!)

Citations basically means writing out the case references etc which you sourced the law from

Sounds like a prescription issue to me but I dont have time to go in to it now. In real life, maybe hiring 'Bermonsey Dave' may be the cheapest option ;)

Read the textbook then. I find that usually helps.

And appropriate citation is the citation you always use, like Page v Smith [1995] 2 All ER 736 at 740 per Lord Denning - or something like that for cases. Citations for articles are different - author title volume journal page
