So the Sgt didn't injure her at all. Nope, no way our brave Sgt did that. It was the concrete floor that did it. :/

Well  she shouldn't have headbutted the floor then should she. If she is going to headbutt a concrete floor what does she expect? Thank goodness that nice officer was there to help her up, otherwise she might have done it again.

Do you not think there's a reason ? Folowing the initial sentence :

Following his conviction, Assistant Chief Constable Patrick Geenty said he was "a disgrace" to the force and added: "There is no place in Wiltshire Police for an officer like this."

You're not wrong !

Is there something in the story that makes you question the initial conviction decision ?

"The appeal judge, Mr Justice Bean, said after the four-day hearing he was satisfied that Sgt Andrews did not intend to throw Ms Somerville into the cell and that injuries she suffered "were probably caused by her falling to the floor after letting go of the door frame".

The appeal judge, Mr Justice Bean, said after the four-day hearing he was satisfied that Josef Fritzel did not intend to incarcerate his children in a windowless cellar and that it was simply a competative game of hide and seek gone awry.

There was a famous Judge Bean in the days of the wild west...

"In one case, an Irishman named Paddy O'Rourke shot a Chinese laborer. A mob of 200 angry Irishmen surrounded the courtroom and threatened to lynch Bean if O'Rourke was not freed. After looking through his law book, Bean ruled that "homicide was the killing of a human being; however, he could find no law against killing a Chinaman".[9] Bean dismissed the case.[9]"

...allegedly along with many similar interesting verdicts.

Quite a mildly amusing film at the time with Paul Newman playing Bean and Stacey Keach making a memorable appearance as the legendary 'Bad Bob'.....not dirty Bad Bob of New Mexico, but the original Bad Bob, the mean one, the albino...

Has anyone seen the video footage? She was clearly being difficult when being led to the cells, and was holding onto the door as he was trying to close it.  Why be so difficult about it in the first place even is you are innocent of failing to provide a breath sample (wonder what her reason was for this) possibly she was too drunk to remember.

Surely the £££ in and compo claim she will probably make will ease her trauma..

It would seem that Wiltshire Police are not too happy with this decision...

Wiltshire Police said it was "surprised and disappointed" by the ruling.

The police force and Wiltshire Police Authority are now considering whether to appeal against the decision by the independent Police Appeals Tribunal.

Mate of mine got pulled over recently driving back from his local Tescos.  The officer was very polite and they had a conversation in which the officer basically explained he'd had to stop my mate for the stats because it was a really quiet night for them.  Asked him where he'd been and where he was going and what he'd gone out for and then left him be.

Needless to say my mate was very relieved.  He'd been out drinking with me a few hours earlier and was petrified that he might have been over the limit if they'd given him a breath test (which they didn't).  On the plus side put the shits well up him and he's not taken that chance again since.

A police officer who was sacked after a woman prisoner was dragged across a floor and thrown in a cell must get his job back, a High Court judge has ruled.
Sgt Mark Andrews was jailed in 2010 for assaulting the 60-year-old, but had his conviction quashed on appeal.
He was sacked by Wiltshire Police, but an appeals tribunal ordered him to be reinstated to his £36,000 a year job.
On Friday, the High Court rejected the force's application for a judicial review of the tribunal ruling.
In his judgement, released on Friday, Mr Justice Ouseley said he expected the order for reinstatement made by the tribunal to be implemented "with full regard to its conclusions, and the failure of this unarguable challenge".

........

Chief Constable Pat Geenty added ....

"The Police Appeals Tribunal accepted that Mark Andrews' actions were intolerant and discreditable and I felt they were a disgrace - there was no place in Wiltshire Police for this behaviour then nor is there now. While I believe the Police Discipline Panel's decision to dismiss Mark Andrews was correct, I accept the legal authority which states he must be reinstated."

So it would seem.
I do find it strange for the Police Discipline Panel that investigated this, and the Chief Constable to be overuled.
In todays world, I suppose we should expect next to hear of a bumper compensation payout for him for the stress and anxiety he's been through, while the poor old woman, that don't forget had the charges brought against her dismissed for lack of evidence, quietly seeths.
It's very odd indeed.

What in God's name is going on here? This excuse for a policeman should still be behind bars.  If a member of the public had assaulted that policeman the same way he attacked the lady, what would be the outcome? Maybe this high court judge shakes hands in a very peculiar manner. :no

Maybe. I've watched the CCTV footage again this morning and the woman is being a complete pain in the arse, doing everything she can to resist being put in the cell which leads to the use of force in the first place.

Its hard to tell what happens really, but to me it looks like he's pulling her into the cell and she's resisting and its almost like she stops resisting as he's pulling which gives the impression he's yanked her in with force, but I do think her resisting then stopping leads to the impression he pulled her in more excessively than he actually did.

;D

In all seriousness I'm not saying that is what happened, I'm saying its a possibility. The CCTV is slightly inconclusive because from within the cell you can't see how much she is resisting being pulled in, and the CCTV from the foyer area isn't great at that distance either. I guess only Sgt. Andrews knows for sure whether his force was excessive.

What I would say if she wasn't being such a stupid bitch then none of this would have happened. That of course isn't an reason for her to be assaulted, if indeed she was assaulted.
